Home Seeker Getaway Summer Promotion ~ Official Rules
The following promotional offer contest includes (4) Maui Home Seeker Getaway for TWO* will be given away weekly during the stated promotional period; (1) Maui Home Seeker Getaways includes* 2 Round trip tickets aboard the Hawaii Superferry to Maui including a personal vehicle from Oahu to Maui. Two night hotel accommodations at the ResortQuest, Kaanapali Shores on Maui. One (1) Grand prize – NCL Cruise for 4 (travel voucher - retail value $4,000) will be given away. Oahu only and shall only be construed and evaluated according to U.S. Law. Do not enter this promotion if you do not reside on Oahu at the time of entry and are not 18 years of age or older as of July 15, 2008. Employees, Sales Associates, family members of Coldwell Banker Pacific Properties, Independent Judging Organization, their parent companies and any other participating sponsors and their advertising and promotional agencies and their immediate family members are not eligible to enter and win.
OFFICIAL RULES:
1. To participate in this promotion you must register for a new Home Seeker account during the promotional period by visiting www.coldwellbankerpacific.com and signing up for a new account or by mailing a complete 3” x 5” postcard with your name, address, valid e-mail address, home and business phone numbers to: Coldwell Banker Pacific Properties , 1314 South King Street, Honolulu, Hi 96814 ATTN: Home Seeker Getaway Summer Promotion.
2. Promotional Dates : This Contest will begin at 12:01a.m. HST on July 15, 2008 and ends at 11:59 p.m. HST August 17, 2008 (the “Contest Period”).
3. By participating , the winners release all sponsors and agents from any and all liabilities with respect to any merchandise or prize. Winners acknowledge that said parties are not responsible in any manner or liable for any warrantee, representation, or guarantee, expressed or implied, in fact or in law, relative to any prize, included but not limited to its quality mechanical condition of fitness.
4. Official Rules . By entering, entrants agree to abide by and be bound by these official rules (“Official Rules”). All on-line and mailed entries become the property of Coldwell Banker Pacific Properties and will not be returned. One entry per household, person and e-mail address . Each mail-in entry must be hand printed and mailed separately and must bear sufficient postage. No mechanical reproductions or facsimiles accepted. Sponsors are not responsible for misdirected, lost, late or illegible entries. Sponsors are also not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions which may limit an entrants ability to participate in the promotion or damage to user's system as a result of participation in the promotion or downloading any information necessary to participate in the promotion. Entrants waive all rights and remedies at law or in equity for any claim they may have relating to this Contest. Contest prizes may include, but are not limited to, (4) Maui Home Seeker Getaways* will be given away weekly during the stated promotional period; (1) Maui Home Seeker Getaways includes* (2) Round trip fares aboard the Hawaii Superferry including a personal vehicle from Oahu to Maui. (2) Night accommodations at the ResortQuest, Kaanapali Shores on Maui. Accommodations are based on availability and are subject to blackout periods (actual dates not identified). Must be used for consecutive nights, no splitting of stay. Not transferable to another person or hotel. No cash value. In the event RQH ceases to manage the hotel/resort, RQH reserves the right to substitute a different RQH property at its discretion. Certificate is not replaceable nor extendable. (1) Grand prize – The Ultimate Home Seeker Getaway NCL Cruise for 4 (travel voucher - retail value $4,000) will be given away. All Prizes are nontransferable, not redeemable for cash if it is prize other than cash and no prize substitutions will be made. The winner will be responsible for any taxes and any associated costs that exceed the stated prize retail value.
5. Reservation of Rights; Disclaimer : Coldwell Banker Pacific Properties reserves the right, in its sole discretion, to cancel or suspend this Contest and randomly award the Prizes from among all eligible entries. Should this Contest be terminated prior to the stated expiration date, notice will be posted at "http://www.coldwellbankerpacific.com". Any attempt to deliberately damage any website or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Coldwell Banker Pacific Properties reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. In the event of a dispute regarding the identity of the person submitting a winning ticket, the entry will be deemed to be submitted by the "authorized ticket holder" person provided that person meets all eligibility criteria set forth in the “Eligibility” section of these Official Rules
6. Prize ; Number of Winners (5) that consists of the following Home Seeker Getaways. (4) Maui Getaway’s for (2) TWO will be given away and (1) Grand Prize will be awarded. Total number of Winner’s five (5). Approximate Retail Value ("ARV") of all Prize(s) is $6,000. Maui Getaways for TWO $500.00 (each) and Grand Prize Value at $4,000. All winners will be notified by the e-mail address provided to Coldwell Banker Pacific Properties when entry was submitted. Should an email address be deemed invalid an alternate winner will be selected until all the prizes are awarded. The Grand Prize winner will be selected on or about September 1, 2008 by a random drawing from among the eligible online and printed entries received and winner will be selected by an independent organization, the decisions of which shall be final and binding. The odds of winning will be determined by the number of eligible, mail-in and on-line entries received. Odds of winning will be equal regardless of method of entry. Coldwell Banker Pacific Properties, travel, hotel and partners reserve the right to substitute a prize of equal or greater value should the featured Prize become unavailable. If a dispute arises regarding who submitted an on-line entry, the entry will be deemed submitted by the holder of the e-mail account. All taxes on any prizes are the responsibility of the winners.
7. Prize Winners. All Prizes will be awarded. Except where prohibited, each winner consents to the use of his/her name, photo, likeness and/or biographical information for advertising and promotional purposes, without additional compensation. Winners release Coldwell Banker Pacific Properties, travel partners, its directors, officers, employees and agents including without limitation its advertising and promotion agencies from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession and or use or misuse of any Prize.
8. Eligibility . This Contest is open to legal Oahu residents and active military personnel and their dependants who are eighteen (18) years of age or older. All federal, state and local laws and regulations apply.
